Abstract

This study examines the characteristics and jurisprudential-legal dimensions of terrorism. Using a descriptive-analytical approach and drawing on library-based resources, the research demonstrates that Islamic teachings not only deem terrorist acts illegitimate but also provide principles that can inform the development of international laws aimed at eradicating terrorism globally. Terrorism has posed significant challenges for many nations in safeguarding their security. The powers prescribed in Iran’s Islamic Penal Code alone may be insufficient to address terrorist crimes, allowing perpetrators to potentially evade justice due to gaps in domestic legislation. To address this, Iran prosecutes offenders under the provisions of its Penal Code. While this framework generally applies to conventional crimes, in the case of terrorist acts, Iranian law through the Civil Aviation Law, Maritime Zones Law, various international agreements, and relevant international instruments has recognized the principle of passive personality jurisdiction, representing a significant step toward achieving effective criminal justice..
